22.  Provision Relating to Election

  1. The Working Committee shall nominate an Eection Officer one month prior to the expiry of the tenure of office of the Working Committee. Likewise, the Working Committee, on the recommendation of the election officer, shall nominate election assistants as per the necessity.
  2. The Working Committee shall prescribe necessary venue and date for election
  3. The other activities relating to the election shall be as determined by the election officer subject to this Statue and the election of all the officials of the Working Committee shall be held in every three years.
  4. After the commencement of this amended Statue, for the purpose of elections an official should have worked for one term in the district to file nominations to the region and one term in the region to file nominations to the center.
  5. Not entitled to take part in the election: An association which is not a member of this Federation or membership has been expired or does not hold the qualification for being candidate or even being a member does not have the qualification to become a candidate, shall not be entitled to take part in the election. For the purpose of voting a member association should have been completed one year from the date of affiliation.

 

23.  Vote of No-confidence

  1. A proposal of vote of no confidence may be brought by one third majority of the Working Committee with reason against any officials or members who have behaved in contrary to the objectives of the Federation or have been failure to discharge the duties of their office.
  2. If a written proposal of vote of no confidence is brought against any Office bearer members it has to be submitted to the Chairperson, if it is against the Chairperson it should be submitted to the Vice-Chairperson and if it is against the Chairperson and the Vice-Chairperson it should be submitted to the General Secretary and on receipt of such proposal a meeting of the Working Committee shall be called within 15 days. The accused person shall be required to be present with clarification in such meeting.
  3. Reasonable opportunity of defense shall be given to such accused person.
  4. If the accused person does not present in the meeting with clarification within the prescribed time limit or the clarification is not satisfactory, two-third majority of the Working Committee may take action against such person showing reasons thereof.
  5. The action taken by the Working Committee shall have to be approved by the General Meeting.

 

24.  Amendment of the Statue

If any Sections or sub sections of this Statue are to be amended, they may be amended by the two third majority of the General Meeting on the recommendation of the Working Committee. In order to make the amended Statue effective, an approval from the Local Adminstration should be obtained. The Statue shall come into forceonly after the approval. Provided that, this Section shall not be subject to amendment.

 

25.  The annual audit report and the progress statement shall be submitted to the Social Welfare Council.

 

26.  To Frame Regulation :

Subject to the prevailing Nepal Laws and not being contrary to this Statue the Working Committee may frame regulation to achieve the objective of this Federation.

 

27.  Dissolution of the Federation :

If the Federation is dissolved all the movable and immovable assets shall be transferred to His Majesty's Government pursuant to the Association Registration Act.

 

28.  The present members shall function as the Working Committee until the election of the Working Committee.

 

29.  Infectiveness :

If any matters provided for in this Statue are innocent with the prevailing laws, they shall to the extent of such inconsistency, ipso facto, be void.

 

30.  Personality of the Federation :

This Federation may acquire, use and dispose the movable and immovable property as a person. Similarly it may sue and it may be used like a person.

 

31.  Discipline :

•  The Federation shall prepare a code of conduct for the office bearer, members and member associations.

•  Action may be taken under the code of conduct against such office bearer members and member associations who do not comply with the code of conduct or do not remain in the discipline.

•  The code of conduct referred to in clause (a) shall be applicable to the office bearer members of all levels.

•  There shall no double responsibility of any person in the association and programmes as per the code of conduct.

 

32.  Interpretation :

The Federation shall have the power to interpret this Statue.
